David Davis arrives at Beverley Magistrates Court

At a hearing at Beverley Magistrates Court on 17th February City Plant Ltd were convicted of five of the charges against them relating to the Gilberdyke Landfill site. Three of the charges relate to the failure of City Plant Ltd to comply with conditions in the operator’s environmental permit.

The other two charges relate to the failure of City Plant Ltd to comply with enforcement notices served on them last year. These required the firm to install a landfill gas collection system and an engineered cap on the site.

Mr Davis said:

“It is a tragedy that a supposedly reputable company has had to be dragged to court in order to ensure they uphold their responsibilities to the local community.

There are now ongoing negotiations between both parties’ legal teams, and the Environment Agency must use the leverage they now have to ensure that City Plant Ltd fulfil all their obligations within a strict court enforced timetable. This will be what everybody will be looking to hear at the sentencing hearing on 15 April.

It is long past time that City Plant Ltd allow the residents of Newport and Gilberdyke the peace and quiet of a decent environment that they have a right to expect.”
